Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the NABE-Gym mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User" or "Member") and the operator of NABE-Gym ("we," "our," or "us"). By creating an account or using the App in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Eligibility

To use the App, you must:

• Be at least 13 years of age
• Have the legal capacity to enter into a binding agreement
• Not be a person barred from using the App under applicable laws
• Provide accurate, current, and complete registration information
• Maintain and update your account information as needed

If you are under 18, you represent that you have obtained parental or guardian consent to use the App.

3. Account Registration & Security

You may register for an account using Google Sign-In or Apple Sign-In. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring the accuracy of your profile information

We reserve the right to suspend or terminate accounts that violate these Terms or are found to be using false or misleading information.

4. App Usage & Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. Prohibited activities include:

• Creating false or misleading profiles
• Attempting to manipulate XP, levels, badges, or leaderboard rankings
• Using automated scripts, bots, or scrapers to interact with the App
• Harassing, threatening, or intimidating other users
• Posting inappropriate, offensive, or harmful content in your profile or posts
• Attempting to breach the security of the App or its infrastructure
• Using the App for any commercial purpose without our prior written consent
• Impersonating any person or entity, or falsely representing your affiliation

5. Gamification & Digital Economy Rules

NABE-Gym features a gamification system including XP (Experience Points), levels, tribes, badges, streaks, and unlockable perks. The following rules apply:

• XP and levels are earned through legitimate in-App activities (check-ins, workouts, challenges, and community participation)
• XP and levels have no monetary value and cannot be bought, sold, or transferred
• Perk unlocks (Priority Booking, Special Event Access, Beta Features, etc.) are non-transferable privileges tied to your account
• We reserve the right to adjust XP values, level thresholds, or perk requirements with reasonable notice
• Any attempt to artificially inflate XP or game the system may result in forfeiture of XP, badges, or account suspension
• Tribe assignments based on Body Metric Test results are final and may be updated only through a new test

6. Gym Check-In & Location Data

The App uses GPS location to verify gym check-ins. By using the check-in feature, you acknowledge:

• Location data is accessed only when you actively use the check-in screen
• Fake or fraudulent check-ins (e.g., using location spoofing) are strictly prohibited
• We reserve the right to disqualify check-ins, revoke XP, or suspend accounts for fraudulent activity
• Repeated abuse of the check-in system may result in permanent account termination

7. Challenges, Squads & Rivals

Participation in challenges, squads, and rivalries is voluntary and subject to the following:

• Challenge rules, duration, and rewards are specified at the time of joining
• We reserve the right to modify or cancel challenges with reasonable notice
• Squad memberships and rivalries may be terminated by either party at any time
• Harassment or abuse of the rival or squad system may result in restrictions
• Sponsor-provided challenge prizes are subject to the sponsor's terms and conditions

8. Health Disclaimer

NABE-Gym is a fitness community and gamification platform. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting any fitness program. You acknowledge that:

• You use the App and participate in fitness activities at your own risk
• We are not responsible for any injuries, health issues, or damages resulting from your use of the App or participation in fitness activities
• Health Connect data is provided "as-is" from your device and we do not guarantee its accuracy
• Body Metric Test results and Tribe assignments are for gamification purposes only and not medical assessments

9. Intellectual Property

All content, trademarks, and intellectual property within the App, including but not limited to the NABE-Gym name, logo, tribe identities (Wolves, Eagles, Sharks, Bison, Gorillas), and gamification system, are owned by or licensed to us.

You may not:

• Copy, modify, distribute, or create derivative works of the App or its content
• Use our trademarks or branding without prior written permission
• Reverse engineer, decompile, or disassemble the App

User-generated content (profile photos, display names) remains your property, but you grant us a non-exclusive, royalty-free license to display it within the App for the purpose of providing our services.

10. Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Conduct that harms other users or the NABE-Gym community
• Extended inactivity (over 12 consecutive months)
• At your request (account deletion via the App or website)

Upon termination, your right to use the App will immediately cease. Your data will be handled in accordance with our Privacy Policy. XP, levels, badges, and other gamification achievements are forfeited upon termination and cannot be reinstated.

11. Limitation of Liability

To the maximum extent permitted by applicable law, NABE-Gym and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. This includes, but is not limited to, loss of XP, levels, badges, data, or access to features.

Our total liability for any claim arising from these Terms or the App shall not exceed the amount you have paid us (if any) in the 12 months preceding the claim.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the App and delete your account.

13. Governing Law

These Terms are governed by the laws of the Republic of Indonesia. Any disputes arising from these Terms shall be resolved through good-faith negotiations first. If negotiations fail, disputes shall be resolved in the courts of Indonesia.

For users in the European Union, these Terms do not affect your statutory rights as a consumer under applicable EU law.
